Abstract

Royal Decree-Law 8/2019, of 8 March, on urgent measures for social protection and the fight against job insecurity in the working day, effective from 12 May 2019, imposes the obligation on companies to record the working day for each working person every day. Additionally, Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights, enshrined the right to disconnect for workers. These two rights are closely linked to ensure effective compliance with restrictions on the working day. At this time of transformation in the world of work these new obligations are going to pose considerable difficulties at the application level. In this context, the article presented seeks to shed light on the practical scope of these new business obligations.
