El control de la valoración de la prueba en segunda instancia: inmediación e inferencias probatorias = Control of the evaluation of the evidence in the second instance: immediacy and evidentiary inferences

Abstract

This article analyzes the relationship between the principle of immediacy and the control of evidentiary reasoning in the second instance. It shows the scope of control that can be carried out on the quality of the evidentiary reasoning without affecting the principle of immediacy, properly understood. To do this, a irst instance criminal sentence is examined, indicating the different steps in the reasoning about the facts it contains and how its shortcomings can be reviewed

Este artículo analiza la relación entre el principio de inmediación y el control del razonamiento probatorio en segunda instancia. Se muestra el alcance del control que puede realizarse sobre la calidad del razonamiento probatorio sin afectar al principio de inmediación, adecuadamente comprendido. Para ello se examina una sentencia penal de primera instancia, indicando los distintos pasos del razonamiento sobre los hechos que contiene y cómo pueden revisarse sus falencias
