The immediacy principle in criminal proceedings has not always been correctly understood. This article analyzes this basic guarantee of the accusatory process, its true meaning and practical scope, since sometimes an exaltation of it has been incurred. The jurisprudential doctrine of the European Court of Human Rights and the Spanish Constitutional Court that the immediacy is also guaranteed in the appeal leads to analyze the value of the video recording of the fi rst degree trial in the assessment of personal evidence.
