Origen y significado del derecho al trabajo: entre el derecho a la existencia y el derecho a los frutos del trabajo

Abstract

[spa]En febrero de 1848, el gobierno provisional francés publica un decreto en el que se compromete a 'garantizar la existencia del obrero a través del trabajo'. Durante los meses siguientes, tiene lugar en la Asamblea Nacional un largo y enérgico debate sobre el derecho al trabajo. El objetivo del texto es explicar el sentido de este derecho en ese momento histórico. ¿Consistía en el compromiso por parte del Estado de dar un trabajo a los desempleados? ¿O era, en cambio, una reivindicación más ambiciosa? ¿Tiene acaso algo que ver el derecho al trabajo de 1848 con la idea de que los trabajadores tienen derecho a los frutos de su trabajo? Para responder a estas preguntas nos remontaremos a la Revolución Francesa, cuando el discurso de los derechos irrumpe con fuerza en la escena política, e iremos trazando algunas de sus transformaciones en los años sucesivos.

[eng]In February 1848, the provisional French government published a decree in which it committed itself to “guarantee the existence of the worker through work”. During the following months, a long and vigorous debate on the right to work took place in the National Assembly. The aim of the text is to explain the meaning of this right at this historic moment. Did it consist in the commitment on the part of the State to give a job to the unemployed? Or was it, instead, a more ambitious demand? Does the right to work of 1848 have anything to do with the idea that workers have the right to the fruits of their labour? To answer these questions we will go back to the French Revolution, when the discourse of rights burst onto the political scene, and we will trace some of its transformations in the following years.
