Dossier sobre la integració europea: especial referència al Brexit i l'estat de dret

Abstract

This dossier takes a systematic look at the most recent works and most relevant resources regarding two aspects of the current state of European integration. Two questions have been chosen on the grounds of their current relevance and specific characteristics. Firstly, the so-called Brexit process and the implications on activating Article 50 of the TEU for the first time, with the specific situations and problems that this brings about, particularly considering that it has been triggered by the United Kingdom of Great Britain and Northern Ireland, given the situation between the Republic of Ireland and Northern Ireland. And secondly, the possible violations of the rule of law by Hungary and Poland, which have led, also for the first time, to activation of the EU rule of law framework and triggering of the preventive mechanism of Article 7 of the TEU, together with actions for breach of obligations. In this dossier, these two challenges have been classified separately, also dealing with the two countries separately in the section on the rule of law

Aquest dossier té per objecte la sistematització de la bibliografia més actualitzada i dels recursos més rellevants sobre dos aspectes en l'estat actual de la integració europea. Per la seva novetat i particularitat, s'han escollit dues qüestions. D'una banda, l'anomenat Brexit, i, per tant, les implicacions de l'activació per primer cop de l'article 50 TUE, amb la particularitat i la problemàtica que en deriven, especialment, pel fet que siguin el Regne Unit de la Gran Bretanya i Irlanda del Nord qui ho hagi fet, atesa la situació entre la República d'Irlanda i Irlanda del Nord. I, de l'altra, les possibles vulneracions de l'estat de dret per part d'Hongria i Polònia, que han comportat, també per primer cop, l'activació del Marc de l'Estat de Dret i de l'inici del mecanisme preventiu de l'article 7 TUE, complementat amb la interposició de recursos d'incompliment. En aquest dossier s'han classificat aquests dos desafiaments de manera separada. Així mateix, a l'apartat relatiu a l'estat de dret també es tracten de manera diferenciada a tots dos països
