Capítulo XXVII. Ruido: estado de la cuestión y retos pendientes en el derecho administrativo

Abstract

More than twelve years after the adoption of the Noise Law 37/2003 of November 17, and once deployed all its effects, in this paper we analyze the current state of the legal system concerning noise from the perspective of the administrative law. The paper initially focuses on the study of regulatory sources and instruments of the basic legislation to combat noise pollution. Next, the effectiveness of these measures is studied by analyzing the assumptions of liability of the administration, by action or omission, on noise and, also, its attempts to modify such liability through legislative reforms. The paper concludes by stressing the pending problems and future challenges in this sector of environmental law

Pasados más de doce años de la aprobación de la Ley 37/2003, de 17 de noviembre, del Ruido y una vez desplegados todos sus efectos, analizamos en este trabajo el estado actual del régimen jurídico en materia de ruido desde la perspectiva del derecho administrativo. Inicialmente a través del estudio de las fuentes reguladoras y los instrumentos de la legislación básica para luchar contra la contaminación acústica. Para posteriormente analizar su eficacia mediante el análisis de los supuestos de responsabilidad patrimonial de la administración, por acción u omisión, en materia de ruido y el intento de matizarla mediante reformas legislativas. Finalmente el trabajo hace hincapié en las problemáticas y retos pendientes de este sector del Derecho ambiental
