Derechos colectivos, derechos de la Naturaleza y defensa de lo común: hoja de ruta para un futuro posible = Collective rights, rights of Nature and defence of the commons: roadmap for a possible future

Abstract

The present text proposes a reflection on the need to articulate three realities called to be protagonists in the framework of the challenges of the ecological and, therefore, social collapse that we are facing. It is a matter, it argues, of combining a series of social and legal-political tools capable of playing a role of creative, transformative contestation. We refer specifically to the role of collective rights, the practices of the commons and the consideration of Nature as a subject of rights. It is argued that there is a potential in these three realities that depends, to a large extent, on their capacity to reinforce each other, to move forward together. The idea is to draw in such synergies a way of reinforcing the transformative capacities of the instituting, of the social practices that, beyond contestation or vindication, are capable of prefiguring, of instituting radically different, necessarily egalitarian, relational patterns that can be expanded and replicated. In short, this text aims to contribute to vindicate the richness and importance of practices that, in the face of the supposed cultural victory of neoliberal individualism, can put the most threatened collective needs in common

El presente texto propone una reflexión sobre la necesidad de articular tres realidades llamadas a ser protagonistas en el marco de los desafíos del colapso ecológico y, por ende, social que enfrentamos. Se trataría, sostiene el escrito, de conjugar una serie de herramientas sociales y jurídico-políticas capaces de desplegar un papel de impugnación creativa, transformadora. Nos referimos concretamente al papel de los derechos colectivos, de las prácticas de lo común y de la consideración de la Naturaleza como sujeto de derechos. Se defiende que en estas tres realidades hay una potencialidad que depende, en buena medida, de su capacidad de reforzarse de modo recíproco, de avanzar conjuntamente. La idea es dibujar en tales sinergias una manera de reforzar las capacidades transformadoras de lo instituyente, de las prácticas sociales que más allá de la impugnación o la reivindicación son capaces de prefigurar, de instituir pautas relacionales radicalmente diferentes, necesariamente igualitarias y que se puedan ampliar, replicar. En definitiva, el presente texto quiere contribuir a reivindicar la riqueza y la importancia de las prácticas que, frente a la supuesta victoria cultural delindividualismo neoliberal, son capaces de poner en común las necesidades colectivas más amenazadas
