Libertades de expresión y libertad religiosa: situaciones de conflicto y criterios para su tratamiento

Abstract

Regarding conflicts between freedom of expression and information and freedom of religion, weighting criteria are not clearly set, and this is further aggravated by the difficulty of determining the legally protected right when trying to limit freedom of expression in name of preserving religious freedom. This paper aims to review how the ECHR has resolved cases of collision between those freedoms; draw conclusions from this case law; define the legally protected right; study the relevance it may have the type ofmedia used to express; substantiate why it's unnecessary to bring these collisions via criminal proceedings; and finally establish sorne criteria which allow legally address the conflict of rights examined here

En lo relativo a los conflictos entre las libertades de expresión e información y la libertad religiosa los criterios de ponderación no están claramente fijados, y ello se ve agravado además por la dificultad de determinar el bien jurídico protegido cuando se pretende limitar las libertades de expresión en nombre de la preservación de la libertad religiosa. El presente trabajo tiene como objeto revisar cómo el TEDH ha resuelto los casos de colisión entre las mencionadas libertades, extraer conclusiones a partir de dicha jurisprudencia, delimitar el bien jurídico protegible, estudiar la relevancia que pueda tener el tipo de soporte empleado para expresarse, fundamentar por qué es innecesario llevar estas colisiones por la vía penal, y finalmente establecer algunos criterios que hayan de permitir afrontar jurídicamente la colisión de derechos que aquí examinamos
