Conflictos de conciencia y servicios públicos: algunos supuestos

Abstract

Everyone is holder of the fundamental right to freedom of thought, conscience and religion, and therefore have the right to manifest their own convictions alone or in community with others, in the public or private sphere, with no more limitation than public order. These manifestations may clash with a legal duty causing conflicts of conscience. In this work we study some of these conflicts in the areas of the public services, Public Health, Public Education, Administration of Justice and Penitentiary Centers

Los ciudadanos son titulares del derecho fundamental de libertad de pensamiento, de conciencia y por tanto tienen derecho a manifestar las propias convicciones individual o colectivamente, en público y en privado, sin más limitación que el orden público. Dichas manifestaciones pueden chocar con un deber jurídico surgiendo conflictos de conciencia. En este trabajo estudiamos algunos de dichos conflictos surgidos en el ámbito de los servicios públicos, la Sanidad Pública, la Enseñanza Pública, la Administración de Justicia y los Centros Penitenciarios
