Análisis contrastivo del convenio regulador de divorcio en chino y español y su aplicación a la traducción

En el ámbito de la traducción jurídica español-chino, aunque ha aumentado el número de estudios en este campo, siguen siendo escasos y necesarios. La mayoría de las investigaciones existentes hasta el momento se centran en la traducción de leyes escritas. Por el contrario, el presente trabajo se interesa por otra tipología de textos jurídicos más concreta, los convenios reguladores de divorcio, que pertenecen a un ámbito concreto del derecho de familia y son esenciales en un proceso de divorcio. En primer lugar, se ha llevado a cabo un análisis textual comparativo a nivel macrotextual y microtextual de un conjunto de convenios reguladores de divorcio españoles y chinos, mediante el cual se han podido detectar diferencias y similitudes entre ellos. Y en segundo lugar, a partir de estos resultados, se han identificado los principales problemas traductológicos con que se enfrentan los traductores de este tipo de textos al traducir del español al chino y se proponen posibles soluciones para resolverlos.

In the field of legal translation between Spanish and Chinese, although the number of studies in this area has increased, the amount of research is still limited and more studies are needed. Most of the research that has been carried out to date focuses on the translation of statutory laws. Nevertheless, this paper is concerned with a more specific type of legal texts, the divorce agreements, which belong to a specific area of family law and are essential in the divorce process. Firstly, this paper presents a comparative analysis of Spanish and Chinese divorce agreements at the level of both macrotext and microtext, through which we find the differences and similarities between them. Secondly, based on these results, we identify the main translation problems faced by translators of such texts when translating from Spanish into Chinese, and propose possible solutions.
