El delito de online child grooming del artículo 183.1 CP: análisis de las conductas típicas y sus problemáticas

El presente trabajo trata de analizar las conductas típicas que integran el tipo penal previsto por el art. 183.1 CP con el fin de resolver las principales problemáticas que estas plantean. La estructura seguida es la siguiente: En la primera parte se hace una breve exégesis del origen legislativo del delito. En ella se incluye un análisis fenomenológico y criminológico del mismo, para luego dar paso al estudio de los antecedentes legislativos del tipo penal en el sistema español. En la segunda parte del trabajo nos adentramos en los elementos que conforman el injusto penal. De un lado, a modo de introducción, efectuamos un sucinto repaso de los elementos comunes al delito. Por otro lado, como núcleo principal del trabajo, analizamos las conductas típicas del art. 183.1 y sus problemáticas. Por último, presentamos las conclusiones resultantes de la investigación.

This thesis aims to analyse the criminal conducts included within the criminal offence described by art. 183.1 of the Spanish Criminal Code, in order to solve its main issues. The paper is structured as it follows: Its first section focuses on the legislative antecedents of the offence, which includes a phenomenological and criminological analysis of it. Its second section deals with the specific criminal conducts of the criminal offence. On the one hand, as an introduction, we dive in the common elements of the offence. On the other hand, working as the core of our thesis, we analyse the criminal conducts of art. 183.1 and the issues that surround them. Finally, we present our conclusions.
