La Cort Penal Internacional (ICC) és el primer tribunal penal internacional permanent del món, l’objectiu principal del qual és posar fi a la impunitat fent responsables les persones que han comès crims greus de preocupació internacional, així com ajudar a evitar que es repeteixin. Com a tribunal d’últim recurs, no pretén substituir sinó complementar els tribunals nacionals, per tant, mentre estigui sota la seva jurisdicció, només actua quan els Estats no poden o no volen actuar-hi en conseqüència. No obstant això, quan es produeix aquesta situació, el Tribunal presenta alguns problemes d’eficàcia pel que fa a la jurisdicció per tractar el cas i l’execució tant de la sentència final com els tràmits necessaris per arribar a aquesta sentència definitiva ja que, entre d’altres, la ICC depèn de la voluntat dels Estats per dur-ho a terme. Així doncs, tot seguint el mètode globalment reconegut de Beth Noveck, aquest treball té com a finalitat descriure dits problemes amb profunditat tot identificant les causes arrel per a posteriori poder fer un bon anàlisi de les possibles solucions i subseqüentment una detallada
proposta final.

The International Criminal Court (ICC) is the world’s first permanent international criminal tribunal whose main goal is to end impunity by holding accountable individuals responsible for committing serious crimes of international concern, as well as helping to prevent them from happening again. As a court of last resort, it does not seek to replace but complement national courts, therefore as long as it falls under its jurisdiction, it only takes action when States can not or will not act on it. Nevertheless, when this situation occurs, the Court presents some efficacy issues when it comes to jurisdiction and execution as, among others, both depend on States’ willingness to act accordingly. However, when this situation occurs, the Court presents some problems of efficacy in terms of having jurisdiction to deal with the case and the execution of either the sentence and the procedures necessary to reach this final judgment since, among others, the ICC depends on the will of States to carry it out. Therefore, following the globally recognized method of Beth Noveck, this work aims to describe said problems in depth by identifying the root causes in order to be able to make a good analysis of the possible solutions and subsequently a detailed final proposal.
