Este estudio tiene como principal objetivo analizar
las percepciones y experiencias de los profesionales del ámbito
de la violencia contra la mujer y de las víctimas de violencia de
género en su tránsito por el proceso judicial, y evaluar de qué
manera se está dando respuesta a las necesidades y derechos de
las víctimas. La muestra la componen 22 profesionales y 23
víctimas. Se realizaron entrevistas en profundidad partiendo de
un guión semi-estructurado. El estudio revela dificultades que
impiden que las necesidades de las víctimas sean cubiertas
satisfactoriamente, en parte por limitaciones intrínsecas a la
justicia penal y en parte por carencias y deficiencias de
funcionamiento que podrían ser corregidas y que generan
victimización secundaria. En cuanto a los derechos de las
víctimas, se han constatado varias deficiencias en la forma como
se cumplen las previsiones legales, especialmente las de la LO
4/2015 sobre el estatuto jurídico de la víctima.
The main goal of this study was to analyze the
perceptions and experiences of professionals in the field of
violence against women and of the victims of gender violence in
their transit through the judicial process and to assess the extent
to which the victims’ needs and rights are addressed. The sample
is composed of 22 professionals and 23 victims. In-depth
interviews have been conducted based on a semi-structured
script. The study revealed difficulties that impede the needs of
victims from being satisfactorily met, partly coming from the
intrinsic limitations to criminal justice and partly due to
shortcomings and deficiencies in the process that could be
corrected and that generate secondary victimization. Concerning
victims' rights, several weaknesses have been found in the way
the legal provisions are implemented, especially those of Organic
Law 4/2015 on the legal status of the victim.
