BilingüeLa voluntat europeista de Catalunya és palesa en la discussió política sobre el seu l’hipotètic
futur independent. La permanència o no de Catalunya a la UE, i els efectes que se’n
derivarien, ha estat i és encara un aspecte controvertit i objecte de discussió en política i la
doctrina jurídica.
L’objecte d’aquest treball és l’anàlisi dels efectes jurídics, en el marc de la UE, de la secessió
d’un territori d’un Estat membre de la UE, concretament Catalunya.
Per això, de la manera més objectiva possible, es procedirà a l’anàlisi de la normativa
internacional i en concret l’acquis communautaire de la Unió Europea, com a institució sui
generis, única al món. S’estudiaran les disposicions normatives, els precedents històrics de
secessions en Estats membres, les diferents interpretacions relatives al procediment
d’integració, i les conseqüències quant a la ciutadania de la UE.
Finalment, es recopilaran els supòsits que es poden donar d’acord amb les diverses
interpretacions de la normativa: la continuïtat, l’adhesió ex novo, l’exclusió, i el procediment
ad hoc, amb els respectius punts forts i dèbils en la seva implementació.Catalonia’s willingness to be part of Europe is reflected in the political discussion about its
hypothetical future independence. The permanence of Catalonia in the EU and the effects
derived of its secession have been and still represent a controversial aspect discussed in
political and legal doctrine.
The purpose of this work is the analysis of the legal effects in the context of the EU secession
of a territory of a Member State of the EU, in particular Catalonia.
Therefore, as objectively as possible, we will proceed to the analysis of international law and
in particular the acquis communautaire of the European Union as an institution sui generis,
unique in the world. We will study the regulations, the historical precedents of secessions in
Member States, the different interpretations regarding the integration procedure and the
consequences relating EU citizens.
Finally, we will explain the different scenarios that may occur according to the different
interpretations of the rules: continuity, adhesion ex novo, exclusion and the ad hoc procedure,
with the respective strengths and weaknesses in implementation.
