Protección de la propiedad intelectual de la medicina tradicional de los pueblos indígenas: especial referencial al caso peruano Protection of the intellectual property of traditional medicine of indigenous peoples: special reference to the peruvian case Jurado Cerrón, Doly Rocio Pueblos indígenas Medicina tradicional Propiedad intelectual Recursos genéticos Los pueblos indígenas, en sus territorios, han albergado una gran variedad de riqueza no solo material, sino también intelectual, desarrollándose y conservándose durante siglos conocimientos que les han permitido sobrevivir y sortear contextos álgidos como los sanitarios. Dentro de esta propiedad intelectual encontramos los conocimientos de la medicina tradicional, cuya protección jurídica se encuentra asociada a los recursos genéticos de los cuales estos proceden. En ese marco, sucesos en los que grandes industrias han accedido a estos conocimientos y los han patentado como propios, privando así a sus autores colectivos originarios, ha motivado esfuerzos desde la comunidad internacional y desde los Estados para regular y articular redes y mecanismos de protección. En esa línea, este artículo busca abordar esta situación desarrollando conceptualmente la regulación respecto a la propiedad intelectual, la protección, el objeto, alcance y manifestaciones de la misma por parte de los pueblos indígenas y el rol que para su preservación ha jugado la OMPI. Asimismo, se identificará los esfuerzos adicionales que desde la comunidad internacional se han realizado a efectos de potenciar su protección y los retos y desafíos ante el avance científico y la no siempre eficaz regulación normativa. Indigenous peoples, in their territories, have harbored a great variety of wealth not only material, but also intellectual, developing and conserving knowledge for centuries that have allowed them to survive and overcome critical contexts such as health. Within this intellectual property we find the knowledge of traditional medicine, whose legal protection is associated with the genetic resources from which they come. In this context, events in which large industries have accessed this knowledge and have patented it as their own, thus depriving its original collective authors, has motivated efforts from the international community and from the States to regulate and articulate protection networks and mechanisms. Along these lines, this article addresses this situation by conceptually developing the regulation regarding intellectual property, the protection, the object, scope and manifestations thereof by indigenous peoples and the role that the World Organization for their preservation has played.
