Este trabajo provee algunas razones teóricas y prácticas que sostienen esa afirmación, concluyendo que los alcances de la relación entre los hechos y el derecho, su calidad de prueba jurídica de los hechos y el desarrollo de determinadas prácticas judiciales dan cuenta de que el derecho está innegablemente implicado en la determinación de los hechos. Al mismo tiempo provee como ejemplo la práctica arbitral chilena, especialmente en materia de arbitraje y construcción. This paper provides some theoretical and practical reasons to support this assertion, concluding that the scope of the relationship between facts and law, their status as legal evidence of facts, and the development of certain judicial practices show that law is undeniably involved in the determining of facts. At the same time, it uses Chilean arbitration practice as an example, particularly in the areas of arbitration and construction.
