La prisión preventiva como medida cautelar hace tiempo no puede ser caracterizada como
excepcional, por lo que resulta necesario que los operadores profundicemos el estudio de la forma en la que
analizamos sus requisitos de procedencia. Este trabajo busca identificar los principales problemas que
presenta la justificación de la existencia de peligros procesales, por entender que en la práctica jurídica es
el que exhibe mayores dificultades. Para ello, se formulan 3 preguntas orientadoras: 1) ¿Qué debe
probarse?, 2) ¿Cómo probamos ello?, y 3) ¿Cuándo estamos justificados a aceptar ciertos contenidos
proposicionales? Atento a que la justificación de la quaestio facti de la prisión preventiva implica la
evaluación de una hipótesis probabilística respecto a la ocurrencia -o no- de hechos futuros, entendiendo
que debe acreditarse la identificación de patrones o frecuencias de eventos que permiten sostener la
existencia del peligro, como así también la garantía y respaldo de dichos argumentos. Asumo que la prueba
estadística es la que nos permitirá determinar el riesgo, proponiendo la formulación de un estándar que
cumpla con los lineamientos establecidos por la Corte IDH y se base en la información brindada por la
prueba estadística, resultando sumamente necesario contar con investigaciones empíricas que la sustentenPre-trial detention as a precautionary measure cannot be characterized as exceptional, so it is
necessary to deepen the study of the way in which we analyze its requirements for admissibility. This work
seeks to identify the main problems that arise in justifying the existence of procedural risks, as it is
understood that, in legal practice, this is the area that presents the greatest difficulties. To this end, three
guiding questions are formulated: 1) What must be proved? 2) How do we prove it? and 3) When are we
justified in accepting certain propositional contents? Given that the justification of the quaestio facti of
pretrial detention involves the evaluation of a probabilistic hypothesis regarding the occurrence—or not—
of future events, it is understood that the identification of patterns or frequencies of events that support the
existence of the risk, as well as the guarantee and backing of such arguments, must be accredited.
I assume that statistical evidence is what will allow us to determine the risk, proposing the formulation of a
standard that meets the guidelines established by the Inter-American Court of Human Rights and is based
on the information provided by statistical evidence, making it extremely necessary to have empirical
research to support it16
