En Perú, la declaración de menores de edad, presuntas víctimas de abuso sexual son
pruebas anticipadas con entrevista por psicólogo forenses en Cámara Gesell que tamiza
preguntas de las partes, presentando problemas de fiabilidad.
Que parten por la carencia de psicólogos forenses, no existiendo psicólogos del
testimonio ni Cámaras Gesell; la aplicación de dos protocolos emitidos por Ministerio
Público 2016 cuando dirigía entrevista el Fiscal y del Poder Judicial 2019; además ambos
requieren del aporte de la Psicología del testimonio; del deferencialismo de los jueces,
fiscales y abogados defensores a las entrevistas sin comprobar su fiabilidad y con
jurisprudencia que ya se refiere a ello, pero debe ser reforzada con la psicología del
testimonio. Por estas razones, se propone que sean psicólogos del testimonio los que
entrevisten a los menores en Cámara Gesell como prueba anticipada, que los actuales
psicólogos tengan segunda especialidad de Psicología del testimonio; que se capacite en
Psicología del testimonio a psicólogos, jueces, fiscales y abogados y que se enseñen
obligatoriamente en Facultades de Psicología y de Derecho en pre y posgrado y Academia
de la magistratura; elaborar un solo Protocolo bajo criterios reforzados de Daubert con
selecta comunidad de expertos y revistas especializadas aprobatorias.In Peru, the declaration of minors, presumed victims of sexual abuse, is anticipated

Psychology of the testimony; that psychologists, judges, prosecutors and lawyers be
trained in the Psychology of testimony and that they be taught in undergraduate and
graduate schools of Psychology and Law and in the Academy of the Judiciary; develop
a single Protocol under reinforced Daubert criteria with a select community of experts
and approving specialized journals.
