El presente trabajo pretende abordar las diferentes formas de utilización del buque.
Realizaremos un breve análisis sobre los contratos antes de la nueva ley de Navegación
Marítima que venían regulados por el Código de comercio de 1885. También
analizaremos las competencias de estos contratos de explotación a nivel
internacional. Veremos que el principal problema de los contratos de explotación
del buque surge de la propia delimitación entre ellos. Estudiaremos los diferentes
tipos de contratos, para diferenciarlos y evitar posibles confusiones ya que todos
ellos comparten una misma naturaleza y un mismo fin, el transporte por mar. El
trabajo se centrará en los contratos de arrendamiento, fletamento por tiempo y
viaje, contrato de remolque, contrato de pasaje, otras modalidades de contratos de
fletamento y como novedad de la nueva ley el arrendamiento náutico. This paper aims to address the different forms of vessel exploitation. We make a
brief analysis of the contracts before the new law of Shipping, where the contracts
were regulated by the Commercial Code of 1885. We also analyse the
competences of these contracts operating internationally. We will see that the main
problem of contracts for operation of the ship arises from the boundary between
them. We will study the different types of existing contracts, to distinguish them and
avoid possible confusions, as they all share the same nature and the same order,
shipping by sea. The focus will be on the leases, time charter and voyage, towing
contract, travel contract, other forms of charter party and the novelty of the new law nautical lease. |
